Michigan Rule-Making Processes Examined
The steps in promulgating a Michigan rule are lengthy and time involved. In
an abbreviated format, the process includes:
- Filing a Request for Rulemaking with the Office of Regulatory Reform,
- Drafting and gaining approval of the language,
- Drafting a Regulatory Impact Statement that assesses the economic
impact of the rule, which must be filed at least 28 days before a public
hearing,
- Scheduling and holding a public hearing,
- Submitting a public hearing report,
- Formally reviewing the proposed rule,
- Legally certifying the rule,
- Certifying the rule within the Board’s statutory authority,
- Submitting the rule to the Joint Committee on Administrative Rules,
- Adopting the rule,
- Filing the rule with the Michigan Secretary of State’s Office, and
- Entering the rule into the Michigan Administrative Code Database.
